Resolution No. 05 - CONAD of 10
November 2004, aims to contribute to the full implementation
of what was discussed
and agreed on "the religious use of ayahuasca”.
CONAD is the regulatory body of the National System
of Public Policies on Drugs - SISNAD - and its decisions "must be respected
by courts and government entities forming part of the" (arts.
3o, I, 4o, 4o, II e 7o, do Decreto no 3.696, de 21/12/2000). Thus,
in exercising its legal jurisdiction approved CATC's opinion that,
in turn, adopted the opinions of board that preceded it - the CONFEN
- and addressed other issues relevant to the topic "The religious
use of ayahuasca" serving to highlight the final point and
conclusions of the opinion that the CONAD approved, "the record
in the minutes for the purpose, including use by interested parties,
there can be no restriction, directly or indirectly, to the religious
practices in the communities based on the prohibition of ritual
use of Ayahuasca."
AYAHUASCA here is used in general terms, to maintain uniformity
and harmony of the text with the nomenclature used in the official
acts of CONAD, but is known by several other names, as the community
that uses it in Brazil or abroad, highlighting the best-known
expressions "hoasca", "Santo Daime" and "Vegetal",
composed, without distinction, by the pelo cipó Banisteriopsis
caapi (jagube, mariri, etc.) and the leaf Psychotria viridis
(chacrona, rainha, etc.).
Ayahuasca tea is the product of the decoction of Banisteriopsis
caapi and Psychotria viridis leaf and its use is restricted to
religious rituals in places approved by the respective leaderships
of the user entities, prohibited its use associated with illicit
drugs.
